This website is operated by Abel Bartolich and Adrienn Bartolich, both registered as independent sole traders in Malta. Throughout the site, the terms “we,” “us,” and “our” refer to Abel Bartolich and Adrienn Bartolich, operating under the name “BARTOART – Art of Nature” (not a registered business name).

Our store offers two types of products:

  • Handmade products – Designed, handcrafted, and shipped directly from our artisan studio in Malta.
  • Print-on-Demand (POD) products – Designed by us, but produced and shipped by our trusted fulfillment partners. Production and shipping are region-specific:
    • United States (US): Monster Digital, SwiftPOD
    • United Kingdom (UK): T Shirt and Sons, Harrier
    • European Union (EU): Print Logistic (Poland), Textildruck Europa (Germany), Harrier (Czech Republic)

For orders containing POD products, the item is manufactured and shipped from the partner facility closest to the delivery destination. In some cases, orders containing both handmade and POD items may be shipped separately.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants, and/or contributors of content.

GENERAL CONDITIONS

We reserve the right to refuse service, cancel an order, or restrict access to our website to anyone, at any time, for any reason, including but not limited to suspected fraudulent activity, abuse of our services, or violation of these Terms.

You understand and agree that any data or content you submit (excluding payment card information) may be transferred unencrypted across various networks and may be adapted to conform to the technical requirements of connecting networks or devices. Credit card and payment information are always encrypted during transfer and processed securely by our trusted payment providers.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service — including but not limited to our handmade products, Print-on-Demand (POD) designs, website content, images, product descriptions, or other intellectual property — without our prior written permission.

Section headings in this agreement are provided for convenience only and do not limit, modify, or otherwise affect the interpretation of these Terms.

PRODUCTS OR SERVICES

Certain products or services are available exclusively online through our website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We make every effort to display product images and colours as accurately as possible. However, we cannot guarantee that your device screen accurately reflects colours or materials, and slight variations may occur.

Handmade Products

All handmade products are designed, created, and carefully finished in our artisan studio in Malta. These include, but are not limited to:

  • Jewellery collections – made from brass, copper, genuine sea glass collected in Malta and Gozo, and rare hand-painted cactus fibre.
  • Copper Etching Prints – fine art prints created using a revived copper relief-etching technique, hand-inked and hand-pressed by us. These prints are produced in limited editions, individually numbered and signed.

Each handmade piece is unique. Small natural variations in colour, texture, or finish are a natural part of the artisanal process and are considered features of the product, not defects. Some items are ready to ship, while others are made to order and may require a few extra days for preparation, especially during busy periods.

All handmade products are packed in our studio in Malta and shipped directly from Malta to the destination country, with full tracking where available.

Print-on-Demand (POD) Products

Our POD products feature original BARTOART designs but are produced and shipped by our trusted manufacturing partners, depending on the delivery region:

  • United States (US): Monster Digital, SwiftPOD
  • United Kingdom (UK): T Shirt and Sons, Harrier
  • European Union (EU): Print Logistic (Poland), Textildruck Europa (Germany), Harrier (Czech Republic)

POD products are always made to order. Processing and shipping times depend on the partner and delivery destination. Orders containing both handmade and POD items may be shipped separately, and delivery times may differ between packages.

Due to the nature of digital printing and regional manufacturing processes, slight variations in colour, placement, or print finish may occur. These variations are normal and do not qualify as defects.

We reserve the right, but are not obligated, to limit sales of our products or Services to any person, geographic region, or jurisdiction, and to adjust quantities or discontinue products at any time without prior notice.

While we make every effort to provide clear, accurate descriptions and images of our products, we do not guarantee that any item or service will meet your personal expectations.

Payment

We accept payments through PayPal or Credit/Debit Card. All credit card transactions are securely processed by PayPal’s payment gateway, using advanced encryption to ensure your data remains protected. Your card details are never shared with us, allowing you to pay with confidence.

All payments, whether for handmade products or Print-on-Demand (POD) products, are processed in EUR by default. You can also choose to view and pay in USD or GBP, with currency conversions updated daily based on the European Central Bank (ECB) exchange rate. The final charge to your account may include minor variations depending on your bank or payment provider’s conversion policy.

Delivery

Legal Compliance and Shipping Availability

We only ship to countries where we meet all legal requirements for tax, customs, and packaging compliance. This ensures that all shipments are processed legally, with accurate invoicing and smooth customs handling.

Print-on-Demand (POD) Products

  • POD products are produced and shipped by our trusted regional partners located in the EU, UK, and US. Orders are always routed to the facility closest to the customer’s location to reduce shipping times, lower costs, and minimize customs procedures.
  • Payment for POD orders is processed directly by us, and we issue a legally valid VAT invoice for every POD order.
  • POD products are available for purchase across the entire EU, UK, and US.
  • VAT for POD orders is charged and remitted by us in accordance with local regulations:
    • For UK orders, VAT is collected and paid directly to HMRC.
    • For EU orders, VAT is reported and remitted through the OSS (One-Stop Shop) system, in compliance with the regulations of the customer’s country of residence.

Handmade Products

  • Handmade products, including jewellery and Copper Etching Prints, are created and shipped directly from our artisan studio in Malta.
  • For Malta and EU destinations, handmade products are invoiced VAT-exempt under Article 11 registration. A physical VAT-exempt receipt is included in the package, issued by Adrienn Bartolich as a sole trader registered under Article 11. Under Maltese and EU regulations, Article 11 traders are legally allowed to issue VAT-exempt receipts for B2C transactions within the EU.
  • For UK and US destinations, all handmade products are invoiced by Abel Bartolich, a sole trader registered under Article 10. These invoices are VAT invoices, including the applicable VAT for the destination country.

For countries outside the EU, UK, and US, shipping will only be made available once all required legal and compliance registrations are completed. Countries not listed on our Delivery Policy page are not currently supported.
